OVERVIEW

Welcome to AURAKHEM.

These Terms of Service (“Terms”) govern your access to and use of the AURAKHEM website, online store, products, customer accounts, content, features, tools, services, communications, and related digital experiences (collectively, the “Services”).

Throughout these Terms, “AURAKHEM,” “we,” “us,” and “our” refer to AURAKHEM. “You,” “your,” “customer,” and “user” refer to any person who visits, browses, accesses, interacts with, creates an account on, submits information through, or purchases from the Services.

AURAKHEM uses Shopify’s ecommerce technology and infrastructure to operate portions of the Services.

Please read these Terms carefully before accessing or using the Services.

By visiting our website, creating an account, placing an order, purchasing a product, submitting information, contacting us through the store, or otherwise using the Services, you agree to be bound by these Terms together with our:

• Return and Refund Policy;
• Shipping Policy; and

If you do not agree with these Terms, you should not access or use the Services.

Nothing in these Terms is intended to exclude, restrict, waive, replace, or override any mandatory consumer right, statutory guarantee, warranty, remedy, or protection that cannot legally be excluded or limited under applicable law.

AURAKHEM offers a curated selection of products that may include:

Our collections may evolve over time.

We reserve the right, subject to applicable law, to:

• introduce new products;
• discontinue products;
• modify available variants;
• update product specifications;
• change materials or finishes where appropriate;
• limit quantities;
• change product availability; and
• update product collections.

SECTION 4 — PRODUCT INFORMATION

We make reasonable efforts to describe and display products accurately.

• descriptions;
• materials;
• colors;
• finishes;
• specifications;
• features;
• care information; and
• compatibility or usage information.

However, the appearance of a product may vary slightly from what appears on your device because of:

• differences between production batches; or
• other reasonable visual variations.

Colors, textures, dimensions, finishes, tones, patterns, and other visual characteristics may therefore vary slightly from images displayed online.

Unless expressly stated otherwise, decorative objects, furniture, props, styling accessories, plants, backgrounds, or other items appearing in product photographs are not necessarily included with the purchased product.

SECTION 5 — PRODUCT SAFETY, CARE AND USE

Customers are responsible for reviewing and following applicable:

• product instructions;
• safety warnings;
• care instructions;
• installation instructions;
• electrical information;
• charging instructions;
• mounting requirements;
• handling requirements; and
• maintenance guidance.

Products should only be used for their intended purpose.

Particular care should be taken with products involving:

• candles;
• open flames;
• heat;
• electricity;
• lighting;
• batteries;
• glass;
• fragile materials;
• hanging;
• mounting; or
• installation.

Never leave a burning candle or open flame unattended.

Where professional electrical installation, mounting, or other specialist installation is required or recommended, customers are responsible for arranging appropriately qualified assistance.

To the extent permitted by law, AURAKHEM is not responsible for damage caused by:

• misuse;
• negligent handling;
• improper installation;
• unauthorized modification;
• failure to follow supplied instructions; or
• use of a product for an unintended purpose.

Nothing in this section limits mandatory consumer rights.

SECTION 6 — ORDERS

Submitting an order through the AURAKHEM store constitutes an offer to purchase the selected products.

An automated order confirmation generally acknowledges receipt of your order but does not necessarily constitute final acceptance in every circumstance.

We may review an order before fulfillment.

An order will generally be considered accepted once:

• payment has been successfully authorized or processed; and
• we begin processing or fulfilling the order.

SECTION 7 — ORDER ACCEPTANCE AND CANCELLATION BY AURAKHEM

We may reasonably refuse, limit, modify, or cancel an order where permitted by law, including where:

• a product becomes unavailable;
• inventory information is incorrect;
• product information contains a material error;
• pricing contains an obvious or material error;
• payment cannot be authorized;
• payment verification fails;
• fraud or unauthorized payment is reasonably suspected;
• shipping information is materially incomplete or incorrect;
• fulfillment is not reasonably possible;
• carrier restrictions prevent shipment;
• legal or regulatory requirements prevent fulfillment; or
• circumstances outside our reasonable control prevent completion of the order.

If AURAKHEM cancels a paid order, the applicable amount paid for the cancelled item or order will be refunded in accordance with applicable law.

SECTION 8 — CUSTOMER ORDER ACCURACY

You are responsible for reviewing your order carefully before completing checkout.

Please confirm:

• product;
• quantity;
• size;
• model;
• color;
• finish;
• variant;
• shipping address;
• billing information;
• contact information; and
• payment information.

If you notice an error after placing an order, please contact us as soon as possible.

We will make reasonable efforts to assist, but changes cannot be guaranteed once processing, fulfillment, or shipment has begun.

Unless expressly agreed otherwise, products purchased through the AURAKHEM store are intended primarily for personal or household use.

• misrepresent an affiliation with AURAKHEM;
• falsely present yourself as an authorized distributor; or
• resell products in a manner that violates applicable law or AURAKHEM intellectual-property rights.

We may limit quantities or cancel suspicious or abusive orders where reasonably necessary and permitted by law.

SECTION 10 — PRICING

Product prices are displayed through the store in the currency available for your selected shopping experience.

Prices may change from time to time.

Price changes generally do not affect a valid order that has already been accepted, except where applicable law permits correction of an obvious or material error.

AURAKHEM may correct pricing errors where reasonably necessary.

If a material pricing error affects a paid order and the order cannot reasonably be fulfilled at the incorrect price, we may cancel the affected order and refund the applicable amount.

SECTION 11 — CURRENCY

Where multiple currencies or currency conversion are available, displayed converted prices may vary because of:

• exchange-rate fluctuations;
• rounding;
• payment-provider conversion rates;
• bank conversion rates; or
• card issuer fees.

Your bank, card issuer, or payment provider may charge conversion or international transaction fees.

AURAKHEM does not control charges independently imposed by banks, payment providers, or card issuers.

SECTION 12 — TAXES, DUTIES AND GOVERNMENT CHARGES

Depending on your location and applicable law, an order may be subject to:

• customs clearance charges;

Where AURAKHEM collects an applicable charge directly, the charge will generally be displayed during checkout where required.

Other fees may be collected separately by:

• logistics providers; or
• other third parties.

SECTION 13 — PAYMENT

By submitting a payment method, you represent that you are authorized to use that payment method.

Payments may be processed by independent third-party payment providers.

We may delay or decline fulfillment where payment cannot be successfully authorized, confirmed, or reasonably verified.

AURAKHEM is not responsible for:

• banking delays;
• payment-provider outages;
• card issuer declines;
• payment-provider currency conversion;
• bank fees; or
• independent charges imposed by your financial institution.

Where payment is reversed, disputed, rejected, or cancelled before fulfillment, AURAKHEM may suspend or cancel the affected order where permitted by law.

SECTION 15 — FRAUD PREVENTION AND VERIFICATION

To protect customers and the store, certain transactions may be subject to:

• fraud screening;
• security checks;
• payment verification;
• address verification; or
• additional order review.

Where reasonably necessary, we may request additional information to verify an order.

An order may be delayed or cancelled where we reasonably believe that:

AURAKHEM ships to eligible destinations made available through our store.

Shipping availability may depend on:

SECTION 17 — SHIPPING COSTS

Delivery timeframes displayed by AURAKHEM are estimates unless expressly stated otherwise.

Delivery may be affected by:

• destination;
• carrier performance;
• fulfillment time;
• customs processing;
• public holidays;
• severe weather;
• remote delivery areas;
• peak shopping periods;
• transportation disruption;
• incorrect delivery information; or
• circumstances outside our reasonable control.

AURAKHEM does not guarantee delivery on a specific date unless such guarantee is expressly provided.

SECTION 19 — DELIVERY INFORMATION

Customers are responsible for providing an accurate, complete, and accessible shipping address.

You should also provide accurate contact information where requested.

AURAKHEM is not responsible for delivery problems caused solely by:

• incorrect addresses;
• incomplete addresses;
• inaccessible delivery locations;
• incorrect contact details;
• refusal of delivery; or
• customer failure to collect a shipment.

Where permitted by law, reasonable additional shipping or redelivery charges may apply.

SECTION 20 — SPLIT SHIPMENTS

Products in the same order may occasionally be fulfilled or shipped separately.

This may occur because of:

• different fulfillment locations;
• product availability;
• logistical requirements;
• product characteristics; or
• carrier arrangements.

Customers may therefore receive more than one package or tracking number for the same order.

AURAKHEM will not charge duplicate standard shipping solely because we decide to split an order into multiple shipments unless additional charges were expressly disclosed and agreed in advance.

SECTION 21 — INTERNATIONAL ORDERS

International orders may be subject to:

• customs processing;
• import duties;
• import taxes;
• brokerage fees;
• clearance fees; or
• other governmental charges.

Unless expressly stated otherwise during checkout, charges imposed directly by customs authorities, carriers, or governments are generally the responsibility of the recipient.

Customs processing times are outside AURAKHEM’s direct control.

SECTION 22 — TRACKING

Where shipment tracking is available, customers may receive tracking details after dispatch.

Tracking information may take time to become active after a shipping label is created or after a package is transferred to a carrier.

Tracking updates are generally generated by third-party carriers.

A delay in tracking updates does not necessarily mean the shipment has not moved.

SECTION 23 — LOST, DELAYED OR DAMAGED SHIPMENTS

If an order appears significantly delayed, lost in transit, or damaged during delivery, please contact AURAKHEM as soon as reasonably possible.

We may request:

• order details;
• tracking information;
• photographs;
• packaging photographs;
• delivery documentation; or
• other reasonable supporting information.

Carrier investigations may be required before a final resolution is available.

Where an issue qualifies for a replacement, refund, partial refund, or another remedy, it will be handled in accordance with applicable law and our store policies.

SECTION 24 — RETURNS

Eligible products may be returned in accordance with our Return and Refund Policy.

AURAKHEM currently provides a 30-day return window for eligible products, measured from delivery or receipt, subject to the conditions and exclusions described in that policy.

Eligible returned products generally must be:

• unused where applicable;
• unaltered;
• complete;
• in resalable condition where applicable;
• returned with relevant accessories and components;
• returned with original packaging where reasonably necessary; and
• supported by proof of purchase.

SECTION 25 — RETURN AUTHORIZATION

Customers must contact AURAKHEM before sending a return.

Do not send a product to an address unless AURAKHEM has first:

• approved or authorized the return; and
• provided or confirmed the appropriate return instructions.

Return destinations may vary depending on the product, supplier, fulfillment location, or logistical requirements.

Sending a product to an unauthorized address may delay or prevent processing.

SECTION 26 — RETURN SHIPPING

For eligible change-of-mind returns, customers are generally responsible for return shipping costs unless:

• applicable law requires otherwise; or
• AURAKHEM expressly agrees to cover the return cost.

Where a return results from an item being:

• incorrect;
• defective;
• materially damaged;
• incomplete; or
• otherwise qualifying because of an issue attributable to AURAKHEM, a supplier, or carrier,

AURAKHEM will provide an appropriate remedy in accordance with applicable law and our Return and Refund Policy.

SECTION 27 — NON-RETURNABLE PRODUCTS

Certain products may be excluded from standard change-of-mind returns where permitted by law.

Examples may include:

• personalized products;
• custom-made items;
• altered products;
• gift cards;
• final-sale items;
• products damaged through misuse;
• products damaged by improper installation;
• products missing major components;
• used or burned candles;
• products that have been materially modified; or
• installed or used lighting that cannot reasonably be resold.

Mandatory consumer rights remain unaffected.

SECTION 28 — REFUNDS

Refunds are processed in accordance with our Return and Refund Policy.

Where a refund is approved, it will generally be issued to the original payment method unless:

• another method is agreed;
• the original method is unavailable; or
• applicable law requires another method.

Payment-provider or banking processing times may affect when funds become visible in your account.

AURAKHEM does not control independent banking processing times.

SECTION 29 — PARTIAL REFUNDS

Where permitted by law, a partial refund may be appropriate where:

• part of an order is affected;
• components are missing;
• packaging has been materially damaged;
• only certain items qualify for a refund;
• excessive handling has reduced the value of an otherwise returnable item; or
• another proportionate remedy is appropriate.

Any deduction will be handled reasonably and in accordance with applicable law.

SECTION 30 — EXCHANGES

Where exchanges are available, customers may be asked to:

1. return the eligible original item; and
2. place a new order for the replacement item.

For incorrect, defective, incomplete, or damaged items, customers should contact AURAKHEM before taking any return action.

SECTION 31 — CUSTOMER CANCELLATIONS

Customers may request cancellation while an order remains unfulfilled.

We will make reasonable efforts to accommodate eligible cancellation requests.

However, cancellation cannot be guaranteed after:

• processing has advanced;
• fulfillment has begun;
• a shipping label has been committed operationally;
• the order has been dispatched; or
• the order has otherwise entered the shipping process.

Where cancellation is no longer possible, an eligible customer may use the return process after delivery.

SECTION 32 — PROMOTIONS AND DISCOUNTS

AURAKHEM may offer:

• promotional codes;
• discounts;
• introductory offers;
• bundles;
• complimentary shipping;
• limited-time promotions; or
• other incentives.

Promotions may:

• expire;
• apply only to selected products;
• apply only to certain markets;
• require a minimum order value;
• be limited to one use;
• be non-transferable; or
• be subject to separate terms.

Unless expressly stated otherwise, promotional offers may not be combined.

SECTION 33 — PROMOTIONAL ERRORS OR ABUSE

We may cancel, refuse, or correct a promotion where reasonably necessary because of:

• fraud;
• unauthorized use;
• manipulation;
• multiple-account abuse;
• pricing error; or
• other material misuse.

Any action taken under this section will remain subject to applicable law.

SECTION 34 — GIFT CARDS AND STORE CREDIT

If AURAKHEM offers gift cards, promotional credit, or store credit, additional terms may apply.

Such terms may concern:

• validity;
• expiration where lawful;
• transferability;
• permitted products;
• fraud prevention; or
• cash redemption.

Mandatory legal protections remain unaffected.

SECTION 35 — INTELLECTUAL PROPERTY

The Services and their content may include intellectual property owned by, licensed to, or lawfully used by AURAKHEM.

This may include:

• the AURAKHEM name;
• logos;
• trademarks;
• visual identity;
• graphics;
• layouts;
• photographs;
• videos;
• artwork;
• product imagery;
• designs;
• written content;
• slogans;
• icons;
• product names;
• marketing concepts; and
• other creative material.

Except where expressly permitted by law or authorized in writing, you may not:

• reproduce;
• copy;
• republish;
• distribute;
• commercially exploit;
• sell;
• modify;
• create derivative works from;
• scrape;
• systematically extract;
• publicly display; or
• otherwise commercially use

protected AURAKHEM intellectual property.

SECTION 36 — TRADEMARKS AND BRANDING

The AURAKHEM name, logo, visual identity, branding, product names, slogans, and associated creative assets must not be used in a manner that falsely suggests:

• sponsorship;
• partnership;
• endorsement;
• affiliation;
• authorization; or
• official representation.

Third-party trademarks remain the property of their respective owners.

SECTION 37 — CUSTOMER REVIEWS AND CONTENT

Customers may be able to submit:

• reviews;
• photographs;
• videos;
• comments;
• testimonials;
• ideas;
• suggestions; or
• other material (“Customer Content”).

By submitting Customer Content, you confirm that you have the lawful right to provide it.

SECTION 38 — CUSTOMER CONTENT RULES

Customer Content must not:

• infringe intellectual-property rights;
• violate privacy rights;
• contain unlawful content;
• be materially misleading;
• contain malicious software;
• impersonate another person;
• falsely represent a customer experience;
• contain threats;
• be defamatory;
• be abusive;
• contain prohibited discrimination; or
• contain fraudulent material.

We may moderate, reject, restrict, or remove Customer Content where reasonably necessary and permitted by law.

SECTION 39 — LICENSE TO CUSTOMER CONTENT

To the extent permitted by law, when you voluntarily submit Customer Content to AURAKHEM, you grant AURAKHEM a:

• worldwide;
• non-exclusive;
• royalty-free;
• transferable where operationally necessary; and
• sublicensable where operationally necessary

license to use, reproduce, adapt, publish, display, distribute, and otherwise use the submitted content for legitimate:

• business;
• customer-service;
• operational;
• marketing;
• promotional; and
• brand communication purposes.

Personal information associated with Customer Content will be handled in accordance with our Privacy Policy.

SECTION 40 — THIRD-PARTY SERVICES

AURAKHEM may rely on third-party providers to operate portions of the Services.

These providers may include:

• Shopify;
• payment processors;
• payment gateways;
• shipping carriers;
• fulfillment providers;
• logistics providers;
• analytics providers;
• translation services;
• advertising platforms;
• social-media platforms;
• email providers;
• customer-support providers; and

Third-party services may also be subject to their own terms and privacy policies.

SECTION 41 — SHOPIFY

Our online store uses Shopify’s ecommerce technology and infrastructure.

Shopify provides technology that enables AURAKHEM to operate parts of the Services.

Products purchased from AURAKHEM are sold by AURAKHEM, not Shopify, unless expressly stated otherwise.

AURAKHEM remains responsible for applicable merchant obligations relating to its:

• products;
• fulfillment;
• shipping;
• policies;
• customer support;
• returns;
• refunds; and
• mandatory consumer obligations.

Shopify remains responsible only for obligations independently applicable to Shopify.

SECTION 42 — THIRD-PARTY LINKS

The Services may contain links to websites, applications, social-media platforms, payment services, or resources operated by third parties.

Providing a link does not necessarily mean that AURAKHEM:

• owns;
• controls;
• endorses;
• guarantees; or
• accepts responsibility for

the linked third-party service.

Your use of third-party websites and services is subject to their own terms and privacy practices.

SECTION 43 — PRIVACY

We respect customer privacy.

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy and data-protection laws.

Depending on your use of the Services, personal information may be processed by providers that help us:

• exploit;
• bypass; or
• interfere with

the security or integrity of the Services without authorization.

AURAKHEM may take reasonable measures to protect:

• customers;
• accounts;
• payments;
• intellectual property;
• systems;
• service providers; and
• infrastructure.

SECTION 48 — ERRORS, INACCURACIES AND OMISSIONS

The Services may occasionally contain:

• typographical errors;
• outdated information;
• technical errors;
• incorrect product information;
• inaccurate availability;
• incorrect delivery estimates;
• pricing errors; or
• omissions.

We may correct or update such information where reasonably necessary.

Where a material error affects an order, we will handle the matter fairly and in accordance with applicable law.

Where a material change affects an existing contractual obligation, applicable customer rights will remain protected.

Nothing in these Terms excludes, limits, or modifies:

• mandatory consumer guarantees;
• statutory warranties;
• legal remedies;
• product safety obligations; or
• consumer-protection rights

that cannot legally be excluded.

SECTION 52 — DISCLAIMER OF NON-MANDATORY WARRANTIES

To the fullest extent permitted by applicable law, and except for warranties or guarantees that cannot legally be excluded, AURAKHEM does not guarantee that:

• the website will always operate without interruption;
• all technical errors will be immediately corrected;
• third-party services will always remain available;
• shipping carriers will always meet estimated delivery times; or
• circumstances outside our reasonable control will not affect the Services.

Mandatory legal rights remain fully applicable.

SECTION 53 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

We will make reasonable efforts to reduce disruption and resume performance where commercially and legally practicable.

These Terms will be governed by the laws applicable to AURAKHEM’s place of establishment, subject to mandatory consumer-protection laws that may apply to you based on your place of residence or the market through which you purchase.

Nothing in these Terms deprives a consumer of mandatory protections that cannot legally be waived.

We encourage customers to contact AURAKHEM first where a problem arises so that we have a reasonable opportunity to resolve the matter.
